Tennessee Theft Laws

In Tennessee, theft occurs when someone takes another person’s property without consent and with the intent to deprive the owner of that property permanently. Common types of theft crimes include larceny, fraud, embezzlement, and concealing or receiving stolen property or services. 

The following is a breakdown of the penalties for theft offenses according to the value of the stolen property or services (TN Code § 39-14-105): 

  • Theft of property or services worth $1,000 or less – Class A misdemeanor, punishable by a maximum jail term of 11 months and 29 days and/or a fine of up to $2,500. 

  • Theft of property or services worth more than $1,000 but less than $2,500 – Class E felony, punishable by imprisonment for up to six (6) years and/or a maximum fine of $3,000. 

  • Theft of property or services worth more than $2,500 but less than $10,000 – Class D felony, punishable by imprisonment for up to 12 years and/or a maximum fine of $5,000. 

  • Theft of property or services worth more than $10,000 but less than $60,000 – Class C felony, punishable by imprisonment for up to 15 years and/or a maximum fine of $10,000. 

  • Theft of property or services worth more than $60,000 but less than $250,000 – Class B felony, punishable by imprisonment for up to 30 years and/or a maximum fine of $25,000. 

  • Theft of property or services worth $250,000 or more – Class A felony, punishable by imprisonment for up to 60 years and/or a maximum fine of $50,000. 

If you are convicted of a theft crime involving property or services valued at less than $1,000, you may qualify for “sentencing alternatives.” Common examples of sentencing alternatives include only paying a fine or restitution, driver’s license suspension, work release, or a community-based alternative to jail time. 

When it comes to shoplifting, stealing merchandise that is worth less than $500 can not only result in criminal penalties, but also a civil action from the retail merchant. If a minor is accused of shoplifting, his/her parents can be held civilly liable for their child’s actions.
